What Alternatives Do I Have to Traditional Penalties?

California Penal Code § 1001.80 lays out the various options that military members have when facing criminal charges. Anytime the defendant is facing misdemeanor charges and was or is currently a member of the U.S. military, they may be placed in a pretrial diversion program for up to two years.

Pretrial diversion programs are used to treat military members suffering from the following:

  • Sexual trauma
  • Traumatic brain injury
  • Post-traumatic stress disorder
  • Substance abuse
  • Mental health problems due to military service

The defendant may be assessed by a mental health authority in order to determine if a pretrial diversion program would be beneficial. This program can suspend the criminal trial for up to two years and upon successful completion, may even erase the defendant's arrest altogether. Military members benefit from pretrial diversion programs because it is a chance to overcome mental health problems and successfully move on without a tarnished criminal record.
