What Alternatives Do I Have to Traditional Penalties?

California Penal Code § 1001.80 lays out the various options that military members have when facing criminal charges. Anytime the defendant is facing misdemeanor charges and was or is currently a member of the U.S. military, they may be placed in a pretrial diversion program for up to two years.

Pretrial diversion programs are used to treat military members suffering from the following:

  • Sexual trauma
  • Traumatic brain injury
  • Post-traumatic stress disorder
  • Substance abuse
  • Mental health problems due to military service

The defendant may be assessed by a mental health authority in order to determine if a pretrial diversion program would be beneficial. This program can suspend the criminal trial for up to two years and upon successful completion, may even erase the defendant's arrest altogether.
